Terms and Conditions

Who are We

Ambersand Video Productions and our trading office is at 14 Westbrook Terrace, Tunbridge Wells, Kent TN2 5BP.
Ambersand Video Productions (“Us” or “We”) offers filming services for corporate and other commercial events (“Goods and Services”).

Provision of Goods and Services
These Terms and Conditions (the “Terms”) represent the sale and provision of Goods and Services by Us and will form the basis of the Contract between Us and our customers (“You”). Before submitting an Order, please ensure that you have read these Terms carefully. If you are unsure about any part of these Terms, please ask Us for clarification.
Your Order constitutes a contractual offer that We may, at our discretion, accept. A legally binding contract between Us and you will be created upon our acceptance of your Order, to purchase our Goods and Services (“Order”) indicated by Our Order Confirmation. Any such Order Confirmation will be provided in writing to you either by email or by post.

By placing an Order with us, You will acknowledge that you have read and fully understand the terms of the wedding contract and realise that this contract becomes effective immediately.

These Terms do not affect your statutory rights.

Booking
A non-refundable payment of 50% of the agreed amount is payable at the time of booking to secure the date/s.

Payment
The balance (less deposit) is due 14 days after delivery of the project and will be payable by You upon receipt of our invoice. BACS payment information is: HSBC Account Name: Anneka Ireland-Wolfe, Sort Code 40-44-20, Account No. 01560131.

Travelling Expenses
All packages include travel expenses up to 60 miles from our editing suite (TN2). For distances greater than this we reserve the right to charge for any extra motoring or rail expenses.

Cancellation
You may cancel this contract at any time prior to the event by giving written notice to Ambersand Video Productions and the deposit will be retained by Us, with no further fees payable.

Coverage
We will try to ensure that your video is filmed without a hitch. However, We are of course all subject to things that may happen beyond our control.
Coverage will be as the cameraman’s professional expertise determines and no one scene will be determined more important than another. Ambersand Video Productions cannot guarantee coverage of any particular event or individual.

We use broadcast quality well maintained equipment, however We are not liable for any radio signal losses, battery failure, equipment failure or material defects which are beyond our control. Every reasonable effort will be made to arrange a replacement cameraman should it be necessary to do so.

In the unlikely event of a total video failure our liabilities are limited to a refund of all monies paid by the client. Ambersand Video Productions also recommends all clients to purchase adequate insurance to cover such instances.

The Edit

Ambersand Video Productions aims to send the first draft within 2 weeks from the filming date. Up to 2 drafts and 1 final are included and thereafter any additional changes may be subjected to a charge.

Copyright
At all times, We retain the copyright of all the videography produced until full payment has been received. Upon receipt of payment the rushes remain the property of Ambersand Video Productions and only with written permission can these be commercially reproduced or resold.

General
We shall have no responsibility or liability for any failure to perform, or delay in performance or any of our obligations under the Terms that is caused by events outside of our control.
You may not assign your rights and obligations under these Terms to any party, and any purported attempt to do so will be null and void. We may transfer (assign) our obligations and rights under these Terms (and under the Contract, as applicable) to a third party (this may happen, for example, if we sell our business). If this occurs, You will be informed by us in writing. Your rights under these Terms will not be affected and our obligations under these Terms will be transferred to the third party who will remain bound by them.
If any part of these Terms is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
No failure or delay by Us in exercising any of Our rights under these Terms and Conditions means that We have waived that right, and no waiver by Us of a breach of any provision of these Terms and Conditions means that We will waive any subsequent breach of the same or any other provision.
These Terms, the Contract, and the relationship between You and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with English law and subject to English jurisdiction.
